Greek Review Board Constitution

Effective August 1, 1994

I. Name

This organization shall be called the Greek Review Board (also known as the "GRB").

II. Purpose

The purpose of the GRB is to assist in arbitrating disputes which arise between Greek organizations, or that may involve Greek organizations. The GRB shall first assist in mediating discussion between member organizations and party who filed a complaint. The primary goal of the GRB is to have the individuals and/or chapters resolve their conflicts through compromise and responsible behavior. However, if mediation is not effective, the GRB may conduct a hearing and levy sanctions on the offending Greek organization. Greek organizations' include all voting and non-voting members of the Interfraternity Council, Panhellenic Council, and any Greek letter National organizations who are affiliated with the National Interfraternity Conference and the National Panhellenic Council.

III. Jurisdiction

The Greek Review Board shall have jurisdiction to hear all charges of misconduct against University recognized IFC or PHC fraternal organizations or members thereof, and any organizations whose National is affiliated with the National Interfraternity Council or the National Panhellenic Council. The Greek Review Board shall have jurisdiction to appoint a mediation team, conduct hearings when needed and impose appropriate sanctions for misconduct or violations of the Greek Code of Conduct, and the Greek Risk Management Policy. Such sanctions shall be final except in those instances where they may be modified by appeal as provided in the Greek Review Board Procedures or referred to other appropriate judicial bodies.

The Greek Review Board is governed by and has jurisdiction over the following documents:

A. Greek Review Board Constitution

B. Greek Review Board By-Laws and Procedures

C. Greek Code of Conduct

D. Greek Risk Management Policy

The Greek Review Board shall hear complaints of students, student organizations, faculty, alumni, and persons affected by the University community. Anonymous complaints will not be allowed.

IV. Membership of the Board

A. The Greek Review Board shall consist of seven voting board members, five of whom shall be matriculated students and initiated and active members of any University recognized fraternity or sorority.

1. Two student board members shall be elected by the IFC.

2. Two student board members shall be elected by the Panhellenic.

3. Two alumni/ae board members - one sorority and one fraternity - shall be elected by the Greek Alumni Advisory Council.

4. A faculty/staff member will be selected by the GAAC.

5. The eighth member shall be determined as follows: if the complaint is against a fraternity, an alternate elected by Panhellenic shall sit on the Board; if the complaint is against a sorority, the alternate elected by IFC shall sit on the Board.

B. The University Greek Advisor shall serve in an advisory capacity. The Advisor will have no vote, but will be present at all meetings, hearings, deliberations, and other meetings of the Board, and will have voice in all these meetings.

C. Eligibility of Student Board Members

1. All student members of the GRB shall be active members in good standing of their respective fraternities/sororities.

2. All student members of the GRB shall have a minimum of a 2.25 cumulative GPA prior to election, and throughout Board term.

3. There may not be more than one Board member or Alternate from the same chapter.

4. A Board member may not serve as Chapter President, nor as an IFC or PHC Executive Board Member, nor as the GAAC Chairperson.

5. All student members of the GRB must have been an initiated member for at least one year.

6. It is recommended that each GRB student member have served as an Executive officer in his/her chapter or on IFC or PHC, or be serving on their chapter Executive Board concurrently.

D. Officers

1. Chairperson - The board members shall select one of the alumni or students as chairperson. The chairperson shall not vote, except to break a tie.

2. Vice Chairperson - The board members shall select one of the alumni or students as vice chairperson. The vice chairperson shall take on the responsibility of the chairperson should he/she not be at the meeting, or is unable to serve as chairperson due to conflict of interest. The vice chairperson shall have a vote, unless chairing the meeting or hearing.

3. Secretary - The board members shall also select a recording secretary to take minutes, and shall have a vote.

E. Removal of Board Member

1. Resignation or Failure to meet Eligibility - In the event a Board member shall resign, or fail to meet the Eligibility requirements as listed above, the member shall immediately lose his/her membership on the Board.

2. Vote to Remove - Greek community members and organizations may request that a Board member be permanently removed from the Board. The request should be submitted to the Board in writing, explaining the reasons for removal request. The Board will then hold a closed meeting to discuss the request, and may ask the complaining party and the Board member in question to appear before the Board. During the closed meeting, the Board member in question shall not be present, unless questioned by the Board.   The Board will then vote to remove the Board member. The Board member shall be removed by a majority (50% +1) vote of the entire Board. Upon removal, the Board member may appeal to the body which elected him/her.  On appeal, the electing body must re-approve the Board member by a 2/3 vote of the voting body. Their vote shall be final.

3. Filling vacant position - Upon a vacancy of any kind, the Chair shall notify the president or Chair of the respective electing body of the vacancy. That Board shall then elect a replacement at their earliest convenience.

4. Position vacancy during Summer - Because none of the electing bodies hold regular meetings during the summer, if needed, the Chair and the Greek Advisor shall appoint a temporary Board member in the event of a vacancy. That representative Council shall then elect a permanent replacement at their earliest convenience in the Fall. The temporary Board member may be a candidate.

V. Term of Office
Each member of the Board will serve for a term of twelve months, commencing with the Spring Semester, except alumni representatives whose terms may be established at the discretion of the GAAC. A member of the Board may be elected to successive terms. If a member is unable to serve or fails to serve, the member's respective council will choose another appointment to serve the remainder of the term.

VI. Meetings

1. Regular Meetings
The GRB shall hold regular monthly meetings during the academic year. The day and time of the meetings shall generally be one hour to one and half hours prior to the monthly GAAC meetings. GRB members shall be notified at the beginning of each semester as to the exact time, dates and place of their regular meetings. Notification shall be done by the Chair and/or the Greek Advisor. Hearings may be conducted at Regular Meetings.

2. Special Meetings
The Chair or the Greek Advisor may call special meetings of the GRB as needed. Special meetings may be held to conduct hearings, personnel matters, or for other administrative functions of the Board. Every effort shall be made to give at least 48 hours notice of Special Meetings.

3. Closed Meetings
All meetings (both Regular and Special) of the GRB shall be closed meetings. A 'closed meeting' is defined as a meeting in which only the members of the GRB and invited participants are present. The parties involved in the hearing may invite appropriate witnesses for testimony. During a hearing, only those individuals immediately concerned with the action at hand shall be allowed in the meeting.

a. The Chair of the GRB may ask any visitor to leave the meeting or hearing at anytime for cause. Suitable reasons for expulsion from a meeting or hearing may include, but not be limited to; disruption of participants, conflict of interest, non-party to the action at hand, or abusive behavior or comments toward the Board or participants.

b. Participants in a hearing may request of the Chair of the Board that a member of the Board be removed from discussion and/or voting for the reason of conflict of interest. The Chair and the Board shall then determine if the request is valid, and that member may then be excluded from the hearing, or from the voting.

VII. Quorum
Five members (including the Chair and the Advisor) of the duly elected members of the Board shall constitute a quorum. In the absence of the Chairperson, a Chairperson pro-tem shall be elected by a majority of those members present.

VIII. Records
Records of disciplinary action taken by the Greek Review Board and any appeals therefrom shall be maintained in the office of the Greek Advisor. All such disciplinary records shall be confidential and only available to the student(s) to which they relate and the University and general fraternity/sorority administrators who have an official need to know, except as provided by law.   When the Greek Review Board receives a request for records from anyone outside the University, no records shall be given without written permission of the students or the organizations against whom the complaint was filed.

XI. Amendments
The Greek Review Board Constitution and all accompanying documents (By-laws and Procedures, Greek Code of Conduct, and Greek Risk Management Policy) may be changed by a 2/3 vote each of IFC, Panhellenic and the GAAC.

X. Effective Date
The Constitution was adopted by vote of the Greek Alumni Advisory Council, the Interfraternity Council and the Panhellenic Council as of December 10, 1987, to be effective as of February 1, 1988.

The March 1989 Amended Constitution was adopted by the IFC, Panhellenic and GAAC, to be effective April 1, 1989.

T he March 1991 Amended Constitution was passed by the IFC on February 19, 1991, by Panhellenic on February 25, 1991, and by the GAAC on March 21, 1991, to be effective on April 1, 1991. (Hazing Policy adopted June 1991).

The May 1994 Revised Constitution was passed by Panhellenic on May 2, 1994, Interfraternity Council on May 3, 1994, and Greek Alumni Advisory Council on May 10, 1994 to be effective on August 1, 1994.
