Native American Graves Protection And Repatriation Act (NAGPRA)

  • Is a federal law enacted in 1990
  • Applies to federal agencies or universities and museums that receive federal funds
  • Provides a process to transfer human remains and certain Native American cultural items from collections back to Tribal communities
  • Applies to ancestral human remains, funerary objects, sacred objects, and objects of cultural patrimony
  • Requires Tribal consultation
  • Is limited to federally-recognized Tribes only

California NAGPRA (CalNAGPRA)

  • State law enacted in 2001 and amended in 2018 and 2020
  • Facilitates the implementation of federal NAGPRA
  • Provides a process for repatriation to California Indian Tribes, regardless of their federal recognition status
  • Recognizes that tribal traditional knowledge is valid, authoritative evidence
