The Office for Civil Rights and Equity serves students and employees who have been impacted by alleged violations of the CSU Nondiscrimination Policy, such as Discrimination or Harassment based on any Protected Status (Age, Disability, Gender, Gender Identity, Gender Expression, Genetic Information, Marital Status, Medical Condition, Nationality, Pregnancy or related conditions, Race or Ethnicity including color, caste, or ancestry, Religion or Religious Creed, Sex including Sex Stereotyping or Sex Characteristics, Sexual Orientation, and Veteran or Military Status), Sexual Harassment, Sexual Misconduct, Sexual Exploitation, Dating Violence, Domestic Violence, Stalking, and Retaliation. Students and employees impacted by any of these types of misconduct are encouraged to contact the Office for Civil Rights and Equity to access the support they may need.

Supportive Measures

Supportive Measures are free, individualized services implemented by the Office for Civil Rights and Equity to enhance individual and community safety while addressing any potential barriers to a student's or employee's equal access to any classes, extracurriculars, or employment following alleged violations of the CSU Nondiscrimination Policy. Supportive Measures can provide tailored support to the person impacted by potential Harassment, Discrimination, Sexual Harassment, Sexual Exploitation, Sexual Misconduct, Dating or Domestic Violence, Stalking, or Retaliation. Anyone who may have experienced these kinds of misconduct is encouraged to contact the Office for Civil Rights and Equity to identify and implement the Supportive Measures best suited for their unique situation. Supportive Measures can also provide support during the complaint or informal resolution process to the person alleged to have violated policy. Anyone participating in an investigation or resolution process is encouraged to connect with the Office for Civil Rights and Equity to request any Supportive Measures relevant to their situation. Supportive Measures are never punitive or disciplinary in nature.

Examples of Supportive Measures

Some common examples of Supportive Measures include counseling, extensions of deadlines or other course adjustments, modifications of work or class schedules, safety escorts around campus, changes to on-campus work or housing locations, assistance with voluntary leaves of absence, increased security in certain areas of campus, and other similar types of services. Another example of a Supportive Measure is called a No-Contact Directive, which is a formal letter from the Office for Civil Rights and Equity to an individual student or employee instructing that person to not communicate directly or indirectly with another identified student or employee. No-Contact Directives clarify that it would be a violation for that one person to speak to, text, call, or share messages to the other person through social media, other people, or other means.

How to Access Supportive Measures

Anyone impacted by behavior that may violate the CSU Nondiscrimination Policy is encouraged to contact the Office for Civil Rights and Equity to access any applicable Supportive Measures. The impacted individual may complete an online report form, email civilrights@fullerton.edu, call the office at 657-278-2121, or visit the office in person in College Park 205 & 207, either with or without an appointment. A Case Management Specialist will offer an intake meeting to discuss appropriate rights and options based on the situation. Both during and after that meeting, the impacted individual – referred to as the Complainant – is empowered to consider what is best for them. The Complainant does not need to share the full details of their experience to access Supportive Measures. This is because the impacted individual does not need to file a Complaint or request an investigation into the alleged misconduct in order to access Supportive Measures. 

Confidentiality Considerations

The Office for Civil Rights and Equity is the only department at CSUF that can implement Supportive Measures following alleged violations of the CSU Nondiscrimination Policy. It is important to know that Supportive Measures are maintained as private as possible. 

If an impacted individual (Complainant) shares about their experience with another CSUF employee outside of the Office for Civil Rights and Equity, that employee may have a responsibility to report the matter to the Office for Civil Rights and Equity so that the Complainant can connect with applicable Supportive Measures and resolution options.  In fact, most CSUF employees are considered Responsible Employees who have a responsibility to report to the Office for Civil Rights and Equity if they know or have reason to know of any acts or allegations of Discrimination or Harassment based on a Protected Status, Sexual Harassment, Sexual Misconduct, Sexual Exploitation, Dating Violence, Domestic Violence, Stalking, or Retaliation. Responsible Employees are required to maintain the privacy of those involved by not sharing out the information widely. However, Responsible Employees are not fully confidential because they do have an obligation to report to the Office for Civil Rights and Equity. Employees at CSUF who do offer confidential services without Responsible Employee obligations are the Campus Confidential Advocates in TitanTHRIVE, physicians in TitanMED, and the psychotherapists, and professional licensed counselors, licensed clinical social workers in CAPS acting solely in those roles or capacities as part of their employment.

Additional Rights and Options for Sex-Based Misconduct

Resources are available to CSUF students and employees who may have experienced Sexual Harassment, Sexual Misconduct, Sexual Exploitation, Dating Violence, Domestic Violence, Stalking, Retaliation, and/or Discrimination or Harassment based on any Protected Status. These resources are available for those who have experienced harm whether they have chosen to report the incident to the university or not. Individuals impacted by Sexual Misconduct, Sexual Assault, Sexual Exploitation, Dating Violence, Domestic Violence, and Stalking have specific rights and options outlined in Attachment D of the CSU Nondiscrimination Policy.
